Acceptance of Terms
By accessing or using the Practivera Platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not access or use the Service.
Description of Service
Practivera is a multi-disciplinary therapy practice management platform providing electronic health records (EHR), scheduling, billing, and clinical documentation tools for healthcare organizations.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
HIPAA Compliance
The Service is designed to support HIPAA compliance. Users must accept a Business Associate Agreement (BAA) before accessing Protected Health Information (PHI). You are responsible for ensuring your use of the Service complies with applicable laws.
Prohibited Uses
You may not: (a) use the Service for unlawful purposes; (b) attempt to gain unauthorized access; (c) transmit malicious code; (d) impersonate another person; (e) use the Service to store non-clinical data in PHI fields.
Intellectual Property
The Service and its original content, features, and functionality are owned by Practivera and are protected by intellectual property laws.
Limitation of Liability
To the maximum extent permitted by law, Practivera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Termination
We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.
Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
